So during the scale test I met some pirates who eventually I bumped into 4 or 5 times in one play through. They had commandeered my ship after killing me twice and eventually we came to an agreement that I would allow them to borrow my one my sloop, to hold their treasure until their four man Galleon (which I had somehow sunk on my own through sheer luck) returned to our location to retrieve the treasure and the crew. After that, every time I bumped into them I was still somewhat nervous of being shot and robbed of my hard earned treasure. But they were friendly to me and wished me luck on all occasions. This gave me an idea.
Parley!
The idea is that in a menu similar to you're crew menu, where you can vote to lock a crew mate in the brig etc. There could be a vote to parley with another crew. But what would that entail you might ask. It's simple. The crews that invoke and agree upon a parley, can't kill each other. Yes they can still sink your ship, and could steal your treasure as any other time. But do you really want to have to go back to the ferry of the damned each time?
Now obviously this isn't without risk. You could parley and the other crew could steal your treasure and you can't kill them to make them drop it, which is why you'd only be advised to parley under confident circumstances. But to avoid this matter slightly, the act of a parley can be broken instantly, unlike the imprisoning of a crew mate where you have to wait a certain amount of time to release them. Parleys should be as quickly revoked as they are to evoke in the first place. To help avoid those untrustworthy scallywags that wish to parley only to backstab you and steal from under your noses.
Edit: As mentioned in a comment below this would also help with boss battles to avoid accidental deaths if you're more concerned about concentrating fire on a boss and wanting to help gain that massive share of loot.
