I generally play as a merchant, am very bad at pvp, and would hate to sink a merchant in the first place.
I was wondering if you sink your ship with a grade 5 emissary flag and sell it would it count towards the Merchant Alliance Ransacked commendation for the hat?

nah
but getting thrown on the same server after a hop is fairly common
on a new boat your old boat's flag would count
so you could get lucky sometimes that way
if you wanna go the peaceful route you can make friends on a server when possible and go on their boat and take your flag, sometimes merchants gotta stick together for the peace.
