Just started the final TT for Shores of Gold and was chased by another ship. Although brig didn't follow in, as I had slowed a bit, and was halfway to the island, and one of the crew members from the brig managed to swim and board me. Is this even possible? Heck, my ship sunk and if I went outside a certain radius of the mermaid I was forced back to the mermaid.

Probably cannoned over or was already tucked on your ship. The shroud doesn't damage swimmers but there is a despawn point for ships without a Shroudbreaker. (Also works on swimmers...) This is why you kept getting spawned back to your mermaid, you had gotten past that despawn point, but not close enough to Tribute for it to spawn you there. Had your ship still been afloat, you would have spawned back to your ship without a mermaid.
