Giving out the Midnight blunderbuss to TwitchCon San Diego's attendees is wrong.

  • As some of you may know, Rare is present at the 2019 TwitchCon in San Diego and they plan to reward attendees with the exclusive Midnight Blunderbuss that was tied to the Sea of Thieves Xbox HDD.

    So while some of you might enjoy this wonderful opportunity to grab a code there, others who purshased the hard drive a year ago feel cheated today. Not only because the Blunderbuss has been marketed as an exclusive item tied to a quite expensive product but also because they decided to just give it out for free today. This basically makes the SoT hard drive product falsely advertised and i'm not sure that this is very legal in regard of the law...

    I kinda want to take that problem to higher instances and notify this on reddit or even consumers protection associations out there. I'm pretty sure Rare is doing a big mistake here and people aren't aware of what is really happenning.

    Any suggestion?

    When a company uses in game assets as an exclusive bonus to make you buy their product and then suddently decides to give that bonus for free later at some event you have to ask yourself : What kind of company am I dealing with and is that legal?

    It does make a difference if they give the code for free to all when they previously used it as a marketing point to sell 3rd party products for real money.

    And it's unfortunate that some people paid for it.

    Have we been lied to? Yes most likely.
    Is that legal? Certainly not.

    You should check ebay prices.
    You should also check the price of the hard drive that this in-game asset was sold with.

    Here are various defintions of the word exclusive for you:

    "Not allowing something else; incompatible.
    Not accompanied by others; single or sole.
    Complete; undivided.
    An exclusive right or privilege, as to market a product."

    I think the sole definition of the word "Exclusive" literally destroyed your arguments up there.

    The product is still falsely advertised.
    A very questionable move from Rare.

    You bought a limited edition hard drive and received the advertised hard drive, you didnt buy the cosmetic code it was just a free giveaway at the time of sale of the hard drive that they tied in with the hard drive.

    Nowhere did it state “Exclusively obtainable with this hard drive”. It said “now with code for the exclusive midnight blunderbuss”, but be my guest and take it to court, i wont hold my breath while you spend a few months salaries on a prematurly lost case

    I left Twitter 6-8 months ago and I'm kind of angry that Rare isn't communicating in other ways to tell players about this kind of giveaway.

  • To use some pirate lingo...its Bad Form.

    They have done very few items that required a cash purchase to get...The Midnight Blunderbuss and the Ferrymen set to be specific. (I don't count the Merc set because most people had to buy XBox Gold time anyways).

    If the plan was to release this stuff for free down the road then that should have been stated from the beginning. (This was stated about all convention drops so why not mention it about the paid purchases too).

    Currently they are offering a limited sail cosmetic with the purchase of the Sea of Theives RPG game. If this is their plan going forward I'll just wait for reviews for the RPG before I consider buying because I'm sure the sails will just drop at some convention 6 months later.

    I assume you have to buy a ticket to get in. In which case they're not giving it away for free, you get it for the price of admission.

    Just checked. Looks like admission was $169 for a three day pass and $99 for a single. And the external harddrive appears to be listed around $160-180 (couldn't be bothered to do more than one search for it).

    So they aren't getting the blunderbus for free. They're getting it for at least a C-note.

    Seems reasonable to me.

  • @hombre You are literrally mixing up the fees related to a 3rd party event that gathers multiples developers, twitch streamers and various partners to the price of a product that has been badly marketed and wasn't made or produced by Twitch AT ALL. How did you come up to the conclusion that the Blunderbuss was part of the TwitchCon fee?

    Use your brain a little more please and stop using your imagination.

    On top of that the issue here is the marketing strategy and the way the product has been promoted in the first place. Most people here don't obviously understand what the term exclusive means. Open a dictionnary.

    The Twitchcon event price has no link with the value of the blunderbuss either. This is your imagination working here in a failed attempt to give them reason.

    Inform yourself about marketing terms and the way they are put to a product. You can't use "Exclusive" like it's nothing especially when that item is tied to a specific sale and sold on par with that item only since 2 years now.

    The in-game asset is a marketing argument for the consumer to buy the product. Because of this exclusivity, a lot of people will want to pushase it. It's as simple.

    You are over complicating this. The word's definition is far enough to define limits, availabilty and terms. No need for an extra notification such as what you said. "Exclusive" is not a 2019 term especially in the marketing field.

    Who told you I want to take this to court? I said I want to spread this information because I strongly doubt that this is legal by informing the relevant authorities.

    Or

    “If you buy this product now you will receive the exclusive midnight blunderbuss”

    Same word but the message is completely different...

    Because that's how you get it.

    You get the blunderbus by attending TwitchCon, and you attend TwitchCon by paying $99-169 for a ticket.

    Rare isn't putting on TwitchCon, they're just giving a code to people who attend. Like how Rare didn't build the harddrive, they just put a code in for people who bought it.

    Maybe you disagree with my logic, but surely said logic is at least understandable.

    I feel like you are taking the quote out of context and think you should provide some photos to back up what you saying. Only photos of the card I can find do not contain what you quoted.

    The way you have it quoted doesn't make much sense, especially toward your own argument. I read it as mentioning two separate things, like tags. This is the Midnight Blunderbus, and this is the Game Drive for storing Xbox Exclusive titles.

  • This is not a big deal. There should be special rewards for people who do special things, like attend gaming conventions, purchase Sea of Thieves hardware, etc. I don't have a problem with this. If items like these weren't rare and exclusive, they'd be valueless.

  • At the time of that the HDD's were manufactured the Midnight Blunderbuss was exclusive to the HDD.

    Rightly or wrongly that is no longer the case but in order to make a legal argument you need to be able to clearly state what specific laws have been broken and how and those arguments need to be made to a relevant legal authority.

    The exclusivity of products changing isn't something that is new so there is likely considerable legal history on such matters. An example of this would be during the last console hardware cycle (XBox 360, PS3, Wii). Microsoft had a number of games or game content that was referred to as 'XBox Exclusive' which later came out on other systems, for Microsoft to be able to call something exclusive they only ensured that it was exclusive for a minimum of 3 months and this was deemed acceptable as at the time those products, regardless of whether they were physical or digital, were exclusive and when that exclusivity period ended those products were no longer marketed as such.

    Regardless if the OP or anyone else feels that Microsoft and or Rare have acted illegally in this matter then this forum is probably not the best place to further that. In the first instance contacting Microsoft or Rare directly would probably be more appropriate, should that fail then escalating the matter to the appropriate authority such as an ombudsman would probably be good course of action.

    They were. And it was. For the hardware purchase.

    When you take those items and rewards and just start tossing them out for whatever other occasion, especially in the stacks these streamers had on their desks for handouts, it defeats the purpose.

    That'd be like if SoT partnered up with Dole, and every bushel of bananas you bought, you'd get the banana sails all of a sudden. It'd be stupid of them to hand it out in such quantity. Or even outside of how it was originally promoted.

    Rare is just so stupidly into streamers these days though...

  • I'd imagine that the 'exclusivity period' has ended. Can't remember 100% I but I seem to recall 90 days being used for some cosmetics 'exclusivity period'.

    Unless it actually states 'Exclusive in Perpetuity' then chances are it will be 'Exclusive' for a while before being made available to all.

    As for giving them away at a convention, Rare has always had event giveaways. It will no doubt be made available to everyone at some point. The stacks they had on the desks are for giving to people attending the Meet and Greet sessions, not a personal stash.

    So lets get some facts straight.

    First, the blunderbuss skin that they are giving away is not "free". You have to buy a ticket and those are not free.

    Next, exclusive doesn't mean what you think it means. Especially since the company can determine how long the exclusivity can last. Same thing with game pass' or exclusive DLC's from other games. They are exclusive UPTO a certain amount of days to let people who paid for the pre-order the first to enjoy the content. So its not something that has been decided that you alone would have forever.

    Next, get off your high horse man. You are seriously overreacting to the situation and it makes me wonder why you even care. I bought like 40 chips ahoy cookies to give my friends and their friends and myself codes. The month after they released those same cosmetics and guess what, I didn't care. Nothing was done to you, Rare didn't lie to you and you have no grounds for any type of legal action. Trust me I know. You think the law is black and white but its not. There are precedents, public understandings, and millions of other things. In this instance the gaming community is under a complete understanding that exclusive doesn't mean forever, and that after a certain amount of days or months the content will be available to others. So you have nothing to stand on.

    Sorry you feel the need to have some ingame cosmetics to make you feel special but I for one don't think they should lock up exclusive content just because your feelings are hurt. I would rather they put all the Black Sea Dog set in the emporium and let people pay a dollar for each skin. Its been over a year since the cosmetics came out. I don't even see players with the cosmetic on and I'm pretty sure you don't even use the skin anymore so why the tears and the whining?

    Hey Rare theres an idea. Put past cosmetics up for sale in the emporium along with the Black Sea Dog sets.

    SIDE NOTE Why are you screaming about this now? Did you miss the part where they gave away the cosmetics multiple times during their stream for free?? Honestly, overreacting way to much over nothing.

  • 100% agreed, they should have re-painted it into something else. Maybe a gray one and call it something similiar.

    The game is about cosmetics but they keep re-using the same ones over and over for events which is silly.

    Im afraid they will start throwing the ferryman set on everyone soon.

    Let me back up things with some pictures fellow over protective Sea of Thieves fans :D

    First here is the front of the HDD Package.

    As you can read the Blunderbuss is an exclusive item..
    But what does exclusive item means in that particular case? Does it mean that I can't have it in-game? Or does that mean that I have to buy the HDD to have it only? Or maybe it's both?

    What i'm sure about though is that no time period and no offer expiration date is mentionned both on the package and the redeem card making this offer permanent.

    Now let's see the Redeem Card itself...

    Wow... look it's written there : "Game Drive for Xbox Exclusive"

    Well I think we got it folks. they literally marketed the Blunderbuss to be exclusively tied to the HDD SoT limited edition product! Making this item unique to those who hold this wonderful limited edtion Hard Drive! xD

    So at first, with that HDD front package, YOU COULD doubt about the meaning of exclusive here, but now that the card inside both confirms what type of exclusivity it is and don't define a precise timeframe for this EXCLUSIVE offer then I think it's clear that both the HDD and the "bonus" in-game asset were falsely advertised.

    I'm not sure if you guys understand how all this works and if you are willing to understand it, but it's okay.

    You have the right to protect you favorite video game franchise against everything, even when clues are given 1 by 1 to destroy your arguments 1 by 1.

    You have the right to stay in the wrong, and keep pretending that the TwitchCon fees are high enough to cover the expense of such an item and it's "okay" to make things exclusive and then turn back on your own fanbase later on.

    You have the right to pretend that it is still exclusive to you and only you because you still don't have it therefore it's still exclusive.. (that argument was the best I have to admit it)

    People... You are all free to be left in the dark, to all be hyped while others feel cheated! It's aaaalll good. Go ahead. Jump on the occasion! The scam.. umm.. the offer won't last long!

    Now I have wasted enough time here explaining logical things. I have that in-game asset since a while anyway and bought it back in the day where codes were cheap and when all of that ebay farce didn't exist... :)
