    They say one of the ways songs enter public domain is through age (meaning authors death) unless the rights are passed onto the authors children

    How long the author has to be dead varies country from country

    @jollyolsteamed yes. And considering the song is from the 1800s and no one knows who wrote it, I'm pretty sure it counts as public domain.
